Rehearing denied December 13, 1983. Following a jury trial the defendant, Michael J. Ahern, was convicted of driving under the influence of intoxicating liquor and improper lane usage (Ill. Rev. Stat. 1981, ch. 95 1/2, pars. 11-501(a), 11-709(a)), and fined in the sum of $100 and $35 respectively. He appeals, contending that the evidence was not sufficient to sustain the convictions, that the statutes allowing him the right to refuse a breath test and then allowing the admission of that refusal into evidence in a criminal prosecution against him are in violation of the Illinois Constitution, and that the admission into evidence that he refused to take a breath test was erroneous and requires reversal.
